1.0 Contact
1.1 Customers, Clients and General Public can expect a reply to abuse emails, within 48 hours 7 days per week, everything else no more than 10 working days
1.2 Customers and Clients can expect a reply to emails, within 5 working day.
2.0 Domain Name Registration and Domain Name Disputes
2.1
The Customer acknowledges that, whilst Steven UK shall use its reasonable endeavours to successfully register the requested domain name(s) on behalf of the Customer, Steven UK shall not be obliged to accept any request to register or continue to process any registration of a domain name.
2.2
The Customer agrees that the domain name(s) requested for registration by Steven UK or any other domain name which the Customer uses in association with any Services provided by Steven UK shall not infringe any Third party rights or Intellectual Property Rights.
2.3
The Customer shall, at all times when using Services provided by Steven UK, abide by all the terms and conditions of the respective Naming Authority.
2.4
Steven UK does not accept any responsibility nor does it make any warranty that the domain name(s) requested for registration by the Customer through Steven UK shall be accepted by the respective Naming Authority nor available for registration by the Customer or any other Persons for whatever reason and Steven UK shall not be liable whatsoever for any costs that the Customer may incur if the request for the registration of such domain name(s) is unsuccessful.
2.5
Steven UK’s obligations in relation to domain name registration shall be limited to forwarding the application to the relevant Naming Authority, providing reasonable administration services in relation to the application and notifying the Customer of the result of the application within a reasonable period after receipt by Steven UK of the result of the application from the relevant Naming Authority.
2.6
Steven UK shall not accept responsibility for any liability to any Third Party as a result of the requested registration of a domain name(s) by the Customer, or any other domain name(s) used in conjunction with any Services by the Customer, where such use or registration is in breach of any Third Party’s Intellectual Property Rights.
2.7
Steven UK reserves the right, at its sole discretion, to suspend, postpone or cancel any request to register a domain name(s) in the event that:
2.2.1
the Customer has materially breached this Agreement or where Steven UK believes that it is the Customers intention to breach this Agreement; or
2.2.2
there are Outstanding Charges.
2.8
The Customer acknowledges that, should any disputes arise out of the registration of any domain name(s), Steven UK is acting under instruction by the Customer and therefore the Customer shall resolve any disputes in accordance with the respective Naming Authority’s dispute resolution policies:
2.8.1
Nominet – http://www.nominet.org.uk/disputes/ – for all .uk domains;
2.9
Steven UK reserves the right to transfer domain names to alternative registrars as and when appropriate for business reasons. Where this is done, domains will regrettably be locked to further transfers for 60 days – however, this will not affect the normal functions of the domain name, DNS or associated services or .uk domain names.
2.10
Nominet the registrar for all .UK domain names have their own terms and conditions, along with dispute resolution services, these can be found below.
3.0
Complaints
3.1
The Customer shall address any complaints concerning the provision of the Services to Steven UK in writing, by post, fax or email, in accordance with Clause 7.
In addition, the Customer may email a complaint to Steven UK at [email protected].
4.0
Force Majeure
4.1
If Steven UK suffers from a Force Majeure Event it shall not be deemed to be in breach of this Agreement or otherwise liable to the Customer for any failure or delay in performance or any non-performance of any obligations under this Agreement (and the time for performance shall be extended accordingly).
5.0
Termination
5.1
Steven UK reserves the right, without any prejudice to any Clauses within this Agreement and any other rights it is entitled to, to terminate this Agreement without any notice upon any of the following events:
5.1.1
any Charges or Additional Charges for Services supplied or any Outstanding Charges remain unpaid for more than ten (10) calendar days;
5.1.2
the Customer is in breach of any of its obligations set out in the Agreement(s);
5.1.3
the Customer materially breaches this Agreement and fails to remedy the breach within twenty (20) calendar days of receipt by the Customer of written notice from Steven UK requesting that the breach be remedied, stating the nature of the breach and indicating that failure to remedy the breach may result in the termination of this Agreement
5.2
Either Party may at any time terminate any Service by serving the other Party with a written notice signed by a duly authorised representative if:
5.2.1
the other Party shall become bankrupt and subject to a voluntary arrangement under Section 1 of the Insolvency Act 1986 or is unable to pay its debt under Section 123 of the Insolvency Act 1986; or
5.2.2
the other Party has ceased trading or threatens to cease trading.
6.0
Effects of Termination
6.1
All Clauses within this Agreement which continue to have effect after the termination of this Agreement shall continue to be enforceable notwithstanding termination.
6.2
Without any prejudice to any Clauses within this Agreement and any other rights to which Steven UK is entitled, the Customer shall pay all Outstanding Charges, if any, that fall due at the time of the termination of this Agreement.
6.3
The Customer shall cease using all Services at termination and Steven UK reserves the write to prevent access by changing login details to the Services without notice following termination.
6.4
Steven UK reserves the right to erase, remove or delete any Data Material from its Network Infrastructure without notice and without any liability to the Customer following the termination of this Agreement and the Customer shall ensure that it has taken a full back-up copy of its Data Material prior to termination.
6.5
Following the termination of this Agreement, Steven UK reserves the right to cease hosting the Customer’s domain names without notice, whereupon the Customer shall become solely responsible for renewing its domain names with the relevant Naming Authority or through another host provider.
7.0 Notices
7.1
Any notice to be given or made by either Party under or in connection with this Agreement must be in writing and given or made to the Customer at its address stated on the Order, and to Steven UK at its Correspondence Address or to such other address as either Party may from time to time notify to each other. Every notice, if so addressed, is deemed to have been duly given or made, if delivered by hand, upon delivery at the address of the relevant Party, if sent by pre-paid first-class post, two (2) calendar days after the date of posting and if transmitted by facsimile, at the time of transmission (provided a confirmatory letter is sent by pre-paid first-class post) provided that, where, in accordance with the above provisions, any notice would otherwise be deemed to be given or made on a day which is not a Business Day or after 4.00 p.m. on a Business Day, such notice shall be deemed to be given or made at 9.00 a.m. on the next Business Day. The Parties may additionally serve notice on each other by email to (i) the Customer’s contact email address as stated on the Order, or (ii) in the case of Steven UK, to the Correspondence Address . In the event of notice by email transmission, emails shall be deemed sent once transmitted from the relevant email server.
8.0
Procuring and Renewal Pricing
8.1
Procuring and Renewal of domain names will be carried out, as details in the individual contract, however our standard policy is set out below.
8.2
Initial domain purchase prices may vary, due to the various sources we obtain the domain names from.
8.2.1
All prices shall be confirmed in writing or verbally before securing and pricing agreed.
8.3
Unless otherwise stated our standard renewal rates are as follows.
.UK as administered by Nominet
.uk £9.99 for 1 year or £14.99 for 2 years.
.co.uk / .org.uk / .me.uk £9.99 for 1 year or £14.99 for 2 years.
.net.uk / .ltd.uk / .plc.uk pricing on application.
8.3.1
Unless otherwise stated our standard drop catching rates are as follows.
.UK (.co.uk/.org.uk/.me.uk/.uk) as administered by Nominet.
Standard Catch with 1 year registration £50 for any domain caught.
Dedicated Catch (Only chasing your name) is £15 non-refundable per day payable regardless of catch success. This provides you to 432,000 look ups on your given day, along with some configuration options. This cannot be carried over if your catch is unsuccessful.
8.4
Our standard policy is to renew names automatically, if you wish to cancel a domain name, please use the contact details within your order form.
8.5
If you wish to transfer away, which is free of charge as long as there are no outstanding fees, please use the contact details on your order form.
